CLSK Scores Another Federal Court Of Appeals ReversalBy Carlson Lynch On November 5, 2014
On November 5, 2014, the United States Court of Appeals for the Fifth Circuit issued a precedential decision, reversing a denial of class certification by the United States District Court for the Southern District of Texas. The underlying class action was filed by CLSK under the ATM fee notice provision of the Electronic Funds Transfer Act. The Fifth Circuit opinion addresses important standing and mootness issues. This decision represents at least the fourth federal appellate reversal that CLSK has secured recently.
